Eligibility and Customer Accounts<\/h2>\n<p>By using the Website and agreeing to these Terms, you represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and are legally able to enter into a binding contract.<\/p>\n<p>To purchase certain Products you may need to register an account. You agree to provide accurate, current and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Products, Descriptions and Availability<\/h2>\n<p>We make every effort to display and describe our Products as accurately as possible, including images, colours, weights, quantities, ingredients and nutritional information. However, we do not warrant that Product descriptions, images, packaging or other Content are accurate, complete, current or error-free. Packaging, ingredients and manufacturer information may change without notice, and the actual Product you receive may differ slightly from the image shown.<\/p>\n<p>All Products are subject to availability. We reserve the right, without obligation and at our sole discretion, to limit the quantity of any Product sold, to limit sales to any person, household, geographic region or jurisdiction, and to discontinue any Product at any time.<\/p>\n<h2>6. Health, Dietary, Allergen and Product-Use Notice<\/h2>\n<p>This Section is important and forms part of the contract between you and us.<\/p>\n<p><strong>Food, dietary and ingredient Products.<\/strong> Nutritional information, ingredient lists and dietary descriptions (including &#8220;keto&#8221;, &#8220;low-carb&#8221;, &#8220;sugar-free&#8221; or similar) are provided for general information only and are based on information supplied by manufacturers, which may change without notice. You are solely responsible for reading the Product label, ingredient and allergen information before consuming or using any Product, particularly if you have any allergy, intolerance, medical condition or dietary requirement.<\/p>\n<p>We do not provide medical, nutritional, dietary or health advice, and nothing on the Website is intended to diagnose, treat, cure or prevent any condition or to constitute such advice. You should consult a qualified healthcare professional before making any dietary changes or before using any Product if you are pregnant, nursing, taking medication, or have a medical condition.<\/p>\n<p><strong>Perfumes and fragrance Products.<\/strong> Perfume and fragrance Products are for external use only and must be used in accordance with any instructions on the packaging. We recommend performing a patch test before full use and discontinuing use immediately if any irritation occurs. Keep away from eyes, children and flames.<\/p>\n<p>To the maximum extent permitted by applicable law, we shall not be liable for any allergic reaction, adverse reaction, illness, skin reaction or other health consequence arising from the consumption, use or misuse of any Product where the relevant ingredient, allergen, warning or usage information was made available on the Product or the Website.<\/p>\n<h2>7. Pricing, Taxes and Payment<\/h2>\n<p>All prices are listed in UAE Dirhams (AED) and, where applicable, are inclusive or exclusive of Value Added Tax (VAT) as indicated at checkout. Prices are subject to change at any time without notice. The price applicable to your Order is the price displayed at the time your Order is confirmed.<\/p>\n<p>Payment is processed securely through our third-party payment service provider and\/or by cash on delivery where offered. We do not store full card details on our own servers. By submitting payment information, you represent that you are authorised to use the payment method and you authorise us (through our provider) to charge the full Order amount.<\/p>\n<p>You agree to provide current, complete and accurate billing and account information for all purchases. We reserve the right to refuse or cancel any Order, and to limit or cancel quantities purchased per person, per household or per Order, including Orders that appear to be placed by dealers or resellers, or that we suspect to be fraudulent. If we change or cancel an Order, we may attempt to notify you using the contact details provided at the time of the Order.<\/p>\n<h2>8. Errors, Inaccuracies and Omissions<\/h2>\n<p>Occasionally information on the Website may contain typographical errors, inaccuracies or omissions relating to Product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any such errors and to change, update or cancel Orders (including after an Order has been submitted) if any information is inaccurate, without prior notice. User Reviews, Comments and Submissions<\/h2>\n<p>If you submit reviews, comments, ideas or other materials (&#8220;Submissions&#8221;), whether requested by us or not, you agree that we may use, edit, copy, publish and distribute them without restriction, without compensation and without any obligation of confidentiality. You are solely responsible for your Submissions and confirm that they are accurate, lawful and do not infringe any third-party rights or contain any unlawful, offensive, defamatory or malicious material. We may, but are not obliged to, monitor, edit or remove any Submission at our sole discretion.<\/p>\n<h2>11. Limitation of Liability<\/h2>\n<p>To the maximum extent permitted by applicable law:<\/p>\n<ul>\n<li>Safwa, together with its owners, partners, managers, employees, agents, suppliers, contractors and service providers, shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including (without limitation) loss of profits, loss of revenue, loss of data, loss of goodwill, or replacement costs, whether based in contract, tort (including negligence), strict liability or otherwise, arising from or relating to your use of (or inability to use) the Website, the Services or any Product;<\/li>\n<li>our total aggregate liability arising out of or in connection with any Order, Product or these Terms shall not exceed the total amount actually paid by you for the specific Product or Order giving rise to the claim; and<\/li>\n<li>you assume full responsibility and risk for your use of the Website and your consumption or use of any Product, in accordance with these Terms (including Section 6).<\/li>\n<\/ul>\n<p>Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the mandatory laws of the United Arab Emirates, including the UAE Consumer Protection Law (Federal Law No. 15 of 2020) and its Executive Regulations. Your statutory rights as a consumer in relation to defective, unsafe or non-conforming goods are not affected by these Terms.<\/p>\n<h2>15. Indemnification<\/h2>\n<p>You agree to indemnify, defend and hold harmless Safwa and its owners, affiliates, partners, officers, employees, agents, contractors, licensors and service providers from and against any claim, demand, loss, liability or expense (including reasonable legal fees) made by any third party arising out of or relating to your breach of these Terms or any policy incorporated by reference, or your violation of any law or the rights of any third party.<\/p>\n<h2>16. Force Majeure<\/h2>\n<p>We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, government action, war, civil unrest, strikes, failure of utilities or telecommunications, courier or supplier delays, or interruption of the internet or the Website.<\/p>\n<h2>17. Termination, Severability, Waiver and Entire Agreement<\/h2>\n<p>These Terms are effective unless and until terminated by either you or us. We may terminate these Terms at any time without notice if we suspect that you have failed to comply with any provision, and you will remain liable for all amounts due up to the date of termination. Obligations and liabilities incurred prior to termination survive termination.<\/p>\n<p>If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. These Terms, together with the policies referenced in them and our <a href=\"https:\/\/safwatrading.ae\/ar\/privacy-policy\/\">Privacy Policy<\/a>, constitute the entire agreement between you and us and supersede any prior agreements. You may not assign or transfer your rights under these Terms without our prior written consent.<\/p>\n<h2>18. Governing Law and Jurisdiction<\/h2>\n<p>These Terms, and any dispute or claim arising out of or in connection with them or your use of the Services, are governed by and construed in accordance with the laws of the United Arab Emirates. You and we agree to submit to the exclusive jurisdiction of the competent courts of the Emirate of Ajman, United Arab Emirates, without prejudice to any mandatory consumer-protection forum available to you under applicable law.<\/p>\n<h2>19. Delivery and Shipping Policy<\/h2>\n<p><strong>Shipping process.<\/strong> We ship our Products via reliable courier services to ensure timely and safe delivery. The method of shipment is determined based on the size, weight and destination of the Order.<\/p>\n<p><strong>Delivery locations.<\/strong> We deliver within the United Arab Emirates and internationally. Available shipping options are displayed at checkout based on your delivery address.<\/p>\n<p><strong>Delivery timeframes.<\/strong> Estimated delivery times are:<\/p>\n<ul>\n<li><strong>Domestic (UAE):<\/strong> usually 3 to 7 business days, depending on location.<\/li>\n<li><strong>International:<\/strong> usually 7 to 21 business days, depending on the destination country and customs clearance.<\/li>\n<\/ul>\n<p>Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by the courier, customs, incorrect address details, or events beyond our reasonable control.<\/p>\n<p><strong>Delivery charges.<\/strong> Shipping charges are calculated based on the weight of the Products and the destination, and are displayed at checkout before you complete your purchase.<\/p>\n<p><strong>Multiple orders.<\/strong> If you place multiple Orders, each Order may be processed and shipped separately, which may result in multiple charges on your statement. We recommend placing all items in a single Order where possible.<\/p>\n<p><strong>Risk and proof of delivery.<\/strong> Risk in the Products passes to you on delivery. Please inspect your Order on delivery and keep your proof-of-delivery receipt, as it may be required for any claim, dispute or chargeback.<\/p>\n<h2>20. Returns and Refund Policy<\/h2>\n<p>Due to the nature of our Products, which include food, consumable and hygiene-sensitive items, returns and refunds are only available in the limited circumstances set out below. This does not affect your mandatory statutory rights in relation to defective or non-conforming goods.<\/p>\n<p><strong>When we accept returns or issue a refund \/ replacement.<\/strong> We will accept a return and, at your preference, provide a replacement or a refund where:<\/p>\n<ul>\n<li>the wrong Product was sent by us;<\/li>\n<li>the Product is defective or faulty;<\/li>\n<li>the Product was damaged during shipping; or<\/li>\n<li>the Product appears to have been tampered with, or arrived expired or past its use-by date.<\/li>\n<\/ul>\n<p><strong>How and when to notify us.<\/strong> You must notify us within 24 to 48 hours of delivery for food, perishable and consumable Products, and within 7 days of receipt for sealed non-perishable Products and perfumes, providing your Order number and clear photographs of the Product and packaging. Returned Products must be sent back in their original, sealed and undamaged packaging using a registered courier service.<\/p>\n<p><strong>Products we cannot accept back.<\/strong> For food safety and hygiene reasons, we do not accept returns of, or provide refunds for, Products that have been opened, used, partially consumed or tampered with, including:<\/p>\n<ul>\n<li>food, grocery, dietary, keto and raw-ingredient Products once the packaging or seal has been opened; and<\/li>\n<li>perfume and fragrance Products once the seal has been broken or the Product has been used.<\/li>\n<\/ul>\n<p>Such Products are only returnable if they are unopened, unused, sealed and in their original condition, or if they fall within the accepted circumstances above (wrong, defective, damaged, tampered or expired on arrival). We reserve the right to refuse a returned Product that has been used, opened or tampered with.<\/p>\n<p><strong>Refund method and timing.<\/strong> Approved refunds are processed only through the original payment method used for the transaction. Shipping and handling fees are non-refundable except where the return results from our error (wrong, defective or damaged Product). Please allow up to 30 days for the refund to be completed, depending on your bank or payment provider.<\/p>\n<h2>21. Cancellation Policy<\/h2>\n<p><strong>Order cancellation.<\/strong> You may cancel your Order within 24 hours of placing it, provided the Order has not yet been dispatched. Once a cancellation is confirmed, any refund due will be processed using the original payment method.<\/p>\n<p><strong>Orders that cannot be cancelled.<\/strong> Orders that have already been dispatched or are in the shipping process cannot be cancelled and are subject to the Returns and Refund Policy above.<\/p>\n<p><strong>Refund timeframe for cancellations.<\/strong> Refunds for cancelled Orders are processed back to the original payment method.
